Custody Decisions Must Prioritize Children’s Best Interests

California courts consider a child’s best interests paramount in any child custody decision they make. They look at many factors to determine what is in the best interest of a child, including:

  • The child’s age and needs (and his or her preference, if old enough)
  • The relationship the child has with each parent and others involved in his or her life
  • The child’s current living arrangement and the stability of any future arrangements
  • The parents’ motivation (are their requests based on their love and affection for their child?)
  • Each parent’s ability to participate in child-rearing and their capacity to cooperate in decision-making
  • How the child will adjust to the proposed arrangements
  • Any history of domestic violence or other threats to a child’s welfare

You should also consider these factors when determining what your children need. Now is not the time to try to get back at the other parent by requesting more time with your child. Remember: Your child will be better able to cope with the divorce if you and the other parent can remain cordial and come up with a plan that works for everyone involved.
